Independent-verifier declaration — why the control layer cannot sit inside the entity it regulates

Every $499 Snapshot ends with a signed declaration from an independent verifier — a party outside the carrier's model team and outside the AI vendor. This is the record peer-state AI bulletins name, the record SC DOI examiners look for, and the record plaintiff's counsel cannot easily impeach.

Why "independent" is the load-bearing word

Three parties routinely offer validation of an AI system:

1. The vendor. Self-interested. Cannot be the sole validator of the product it sells.
2. The internal modeling team. Also self-interested. Also cannot be the sole validator of its own work.
3. An external party outside both. The only party whose validation is structurally credible.

NAIC Model Bulletin Section 4.2 language ("independent review") points at exactly this. The peer-state AI bulletins that echo it do the same. The word "independent" is not decorative.

What the declaration includes

• Scope — the specific AI system, model version (sc-claims-severity-v2.3.1), and audit period (90 days)
• Method — the four sensor thresholds, the county-group segmentation, the baseline window
• Findings — drift events by severity, per-county-group distributional shape, lane-shift rates
• Determination — A / B / C with the reasoning
• 3 fix-first items — scoped to the specific control gaps identified
• Signature block — dated, named, with verifier standing statement

What "independent" specifically requires here

What the declaration does NOT do

• It is not an opinion of counsel
• It is not an actuarial certification
• It is not an SC DOI-issued approval
• It is not a substitute for the carrier's own written AI program

It IS a dated, signed, methodology-transparent third-party record of what the AI system was doing during the audit period, produced by a party outside the carrier and outside the vendor. That is the record peer-state bulletins call for.

Why this matters at exam time

When the SC DOI's market-conduct exam letter asks how AI-driven decisions are validated, the answer "our vendor says the model works" is not sufficient under any peer-state bulletin framework. The answer "our internal modeling team reviewed it" is closer but still self-interested. The answer "here is a dated, signed, independent-verifier declaration from a third party outside the modeling team and outside the vendor" is the answer peer-state examiners are trained to accept.
